PRIVACY POLICY
This page explains what personal information we collect, why we collect it, who we share it with and the choices you have. It also covers the cookies used on this website.
Who we are
Department of Lost Nights is a digital marketing agency based in London, United Kingdom. We are the controller of the personal information described in this policy.
For any question about this policy, or to use any of your rights, email hello@departmentoflostnights.com.
What we collect
- Enquiries. When you fill in a form on this site or email us, we collect what you give us: your name, email address, phone number, company, the services you are interested in, your budget and anything you write in your message.
- Website usage. If you accept cookies, we collect information about your visit: the pages you view, how you arrived, your device and browser, your approximate location based on your IP address, and cookie identifiers.
- Business contact details. If we contact your business about our services, we use details your business has made public, for example on its website or its Google Business Profile.
- Client work. If you become a client, we agree separately how we handle the information involved in that work.
How we use it
We only use personal information where the law allows us to. In practice:
- To reply to enquiries and prepare audits and quotes. Our basis is our legitimate interest in responding to you, or taking steps you have asked for before entering into a contract.
- To tell businesses about our services. Our basis is our legitimate interest in finding new clients. You can tell us to stop at any time and we will.
- To understand how this site is used and measure our advertising. Our basis is your consent, given through the cookie banner. You can withdraw it at any time.
- To keep business, tax and legal records. Our basis is our legal obligations and our legitimate interest in running the business properly.
We do not sell personal information, and we do not use it for automated decisions.
Cookies
Cookies and similar technologies store small amounts of information in your browser. We use two kinds.
- Essential. We store your cookie choice in your browser so we do not ask on every page. This does not need your consent and does not track you.
- Analytics and marketing. These are only switched on if you accept them. They are Google Tag Manager, which we use to run Google Analytics and Google Ads measurement; the Meta Pixel, which measures and helps target our advertising on Facebook and Instagram; and HubSpot, which recognises returning visitors and links visits to enquiries.
We ask for your choice again after about six months. You can change it at any time:
This site also loads its fonts from Google Fonts, so your browser contacts Google's servers when a page loads.
Who we share it with
We share personal information only with companies that provide services to us, and only as far as they need it:
- HubSpot, our customer relationship system, where we keep enquiries and contact records.
- Google and Meta, for analytics and advertising measurement, if you accept cookies.
- Our email and website hosting providers.
Some of these companies process information outside the United Kingdom. Where that happens, we rely on safeguards recognised under UK data protection law, such as adequacy regulations or approved contract terms.
How long we keep it
- Enquiries: while we are in conversation, and for up to two years after our last contact.
- Client records: for as long as we work together, and afterwards for as long as tax and legal rules require.
- Cookie choice: about six months, after which we ask again.
Your rights
Under UK data protection law you can ask us to:
- give you a copy of the personal information we hold about you;
- correct anything that is wrong or incomplete;
- delete your information, or limit how we use it;
- stop using your information for marketing or outreach;
- send your information to you or another organisation in a portable format.
Where we rely on your consent, you can withdraw it at any time. To use any of these rights, email hello@departmentoflostnights.com. We will reply within one month.
If you are unhappy with how we have handled your information, you can complain to the Information Commissioner's Office at ico.org.uk. We would appreciate the chance to put things right first.
Changes to this policy
We will update this page if the way we handle personal information changes, and change the date at the top when we do.
